1.4 This document will also refer to the customer or advertiser with the words "advertiser", "your" & "you"

3.1 Free listings which have been newly added or have been Edited / Updated will be given a login feature to access the dashboard for that account.
3.2 Your Free listing will be placed and published with the gomy.co.uk website. The terms of this Agreement apply to your free listing, but we request that you read our current Terms at least once every 12 months ~ You also agree that gomy.co.uk can change these terms anytime ***Please note: Although we may change our Terms YOU WILL NEVER BE CHARGED FOR A FREE LISTING***
3.3 As a free advertiser you will receive a free basic listing ~ Any decisions you make to upgrade your listing to a Paid listing, will naturally apply to the PAID BUSINESS LISTING(s) section of these Terms.
3.4 As the administrator of a Free listed business you must agree to these terms.
Monthly Payments (All paid accounts)
4.1 As a Monthly paying Advertiser you agree to purchase monthly advertising and / or additional features for your Web Advertisement with gomy.co.uk.
4.2 Your Web placement, and set up fees total the monthly amount and levels of advertisement you choose from the Payment and Options Pages of this site.
4.3 Monthly payments will automatically recur each calendar month for a total of 12 months unless cancelled by you or by us – See Cancellation (below). After 12 months this contract will automatically renew for an identical 12 month like term.
4.4 In the event gomy.co.uk changes these Terms and / or pricing, we will contact you before the start of any new 12 month contract starts (Your payments will never increase without your approval).
4.5 Monthly PAID advertising prices include VAT at the current rate(s), and include full technical support when / and if needed.
Yearly Payments (All paid accounts)
4.6 As a Yearly paying Advertiser you agree to purchase Yearly advertising and / or additional features for your Web Advertisement with gomy.co.uk
4.7 Your Web placement, and set up fees total the Yearly amount and levels of advertisement you choose from the Payment and Options Pages of this site.
4.8 Yearly payments will automatically recur each 12 months for an indefinite period unless cancelled by you or by us – See Cancellation (below). After 12 months this contract will automatically renew for an identical 12 month like term.
4.9 In the event gomy.co.uk changes these Terms and / or pricing, we will contact you before the start of any new 12 month contract starts (Your payments will never increase without your approval).
4.10 Yearly PAID advertising prices include VAT at the current rate(s), and include full technical support when / and if needed.
4.11 As the administrator of a Paid listed business you must agree to these terms.
You agree that gomy.co.uk will review all content of a listing for its suitability to our website, you also accept that gomy.co.uk reserves the right to refuse any advertisement that we regard as unacceptable, harmful, racial or inappropriate for any reason.
6.1 Paying advertisers pay for a Monthly or Yearly advertisement which includes all placement and set up fees.
6.2 All payment cycles Monthly or Yearly will automatically renew for a like term – there is no expiration to this contract as any party can cancel anytime. You will be contacted and made aware of any future price increase at least 28 days before your next scheduled payment. *We will not increase the price of your advertisement anytime in the future unless making you fully aware of it by clear and concise means*
6.3 All Monthly and Yearly payments are final and no refunds will be given unless agreed upon by both parties.
6.4 Any future price changes whether increased or decreased will be offered to you before any payments are taken.
6.5 Declined credit cards or unqualified and returned checks may incur a charge from our banks and / or our credit merchants. Any applicable charges may be subject to a service fee to cover costs (only if applicable and applied by our merchants).
7.1 All Yearly and Monthly contracts, agreements and payments can be cancelled anytime, by any party before the next Monthly or Yearly payment occurs. gomy.co.uk does not charge a cancellation fee.
7.2 Cancellation must be in writing to our head office at: 16 Foundry Street, Rawtenstall, Lancashire. BB4 6HQ or by contacting us from our contact page before the date of your next due payment.
8.1 gomy.co.uk agrees to perform production work including layouts, attachments and wording to all Paid listings if requested.
8.2 Any materials needed for attachments or used as an image file, meaning company logo or photograph will need to available to copy from the customer’s website, delivered to gomy.co.uk by hand, by email, by regular mail.
8.3 Such advertising to be placed and published with the gomy.co.uk website, starting the date this contract is agreed upon or the date your new listing(s) is "Live" Paid for and published.
8.4 gomy.co.uk agrees to spend a portion of Advertisement revenues received to market and drive users to the gomy.co.uk website, suggesting people log in and use it as a source of information - gomy.co.uk will make all decisions on how much the advertising budget will be per area, city or nationally.
8.5 You will be given, or will have created their own personal client login – which gives you the ability to change wording, images, links and numbers. gomy.co.uk gives the You as much editorial freedom to Your personal web space as we see possible.
9.1 You warrant that You the right to use all material submitted to gomy.co.uk and such material does not violate any applicable law, copyright, regulation or ordinance.
9.2 You agree that gomy.co.uk shall not be liable for any loss, injury or damage of whatever kind caused in whole or in part by use of the Website or the information provided therein, or by any failure, delay, interruption or otherwise of the provision of the Website or the information provided therein.
9.3 gomy.co.uk shall use due care and diligence in the publication of Your information, & shall not be responsible for errors, omissions, misprints or mistakes.
9.4 You agree to save, hold harmless and defend gomy.co.uk of, and from any and all claims or copyright laws, causes, demands, actions, liabilities, losses, expenses, damages, privacy infringements, criminal investigations, false or deceptive advertising, publication of any pornographic images or attachments, or anything considered to be of bad taste, any virus, contaminating or destructive features. You agree to pay all costs including all lawyer fees that may be incurred by us or You arising out of, or in connection with a breach of this Agreement or arising out of the advertising material(s) submitted to, and published by gomy.co.uk.
10.1 gomy.co.uk is committed to protecting the privacy of Business owners and their representatives. Under no circumstances will gomy.co.uk sell or share your private information with anybody unless permitted to by law. Please read our Privacy Policy for additional user related Privacy.
10.2 The only information we display publicly within the site is for creating your public awareness and marketing your business. Not limited to, but including Passwords and Email Addresses are securely stored for our communications with you. With a Paid business listing we link to your email address through our secure email forms for your customer interaction. Paid Gold listings do have the editorial freedom to add a visible direct email link in full display if required.
10.3 gomy.co.uk does not, and has no intension of storing, saving or keeping any kind of copy of your financial details, bank details or credit and debit card details.
10.4 gomy.co.uk carefully selects highly secure merchant companies to handle its payment processing procedures; these companies include but are certainly not limited to PayPal. We advise you to take a look at their Privacy Policy for further information on how they store financial details.
11.1 gomy.co.uk has a commitment to keep our Website available at all agreed times, but in the event of any errors which are beyond our control you acknowledge that computer and telecommunication systems are not 100% error free, and that we will not be liable to you in the event that the Website or any of the Services become unavailable or inaccessible.

11.4 In relation to Business Owners and their Representatives submitting their information to the site, these Terms shall constitute the entire agreement between You and gomy.co.uk and shall be governed by and construed in accordance with the laws of England and the parties hereby agree to the exclusive jurisdiction of the courts of England.
